Coquille Valley Hospital Clinic prefers NOT to follow HIPAA rules and other federal guidelines

Re:  Medical Records for Ms. XXX X.XXX, DOB XX-XX-XX

I want to discuss concerns I have regarding the behavior of your staff towards my office.

Namely a Medical Asst. from your office called on 12-12-19 at 9:51am requesting that chart notes for Ms. XXX be faxed to your office ASAP for her appointment that day at 10:00am.  So your staff basically wanted us to comply and fax records within 9 minutes!

I don't know what type of clinic that you run there, but I am sure that if my staff called your office and wanted records for any of our patients within 10 minutes they would have been laughed off.

Your MA was "upset" per my MA when she wanted your MA to fax over a ROI due to the fact that we have nothing on file from your office.  Your MA claimed that since you were the "referring provider" that a ROI was unnecessary.

There's a lot wrong with that statement.  Firstly, your office did not "refer" Ms. XXX.  You did not send any referral.  Ms. XXX did her own internet search to find our ofice due to no chronic pain management being available in her area.  Secondly, since no office has ever complied with our referral requirements, Ms. XXX had to complete all our new patient requirements herself. 

Did you send the last two years of all her PCP records to us before we accepted her into our clinic?  No. 

Did you ensure that we had the last two years of records from all her other providers?  No. 

Did you ensure that we had the last two years of all her pharmacy records?  No. 

Did you have her complete our application, Oregon State Police search request, and perform a 3-year search of the Oregon PDMP?  No. 

We request this of all of our new applicants and I personally review all of the above before I ever accept any patient into my practice.  I don't take insurance so I make my own rules.  You have to play by insurance company demands, denials, gag orders, and more.

Your office faxed a ROI on 12-12-19 for Ms. XXX's reocrds.  Your ROI is incomplete and does not comply with federal guidelines.  See my attached form so that you can make the appropriate corrections.  Your next ROI that fails to meet the guidelines will be denied.  I have attached a copy of our ROI for your review.
